TUPE – the Transfer of Undertakings (Protection of Employment) Regulations 2006 – protects employees’ rights when the business or service they work for changes ownership. It applies in two main situations: a TUPE transfer of a business or part of a business from one employer to another, and a service provision change (where a contract switches from one supplier to another).
Under TUPE, employees automatically transfer to the new employer on their existing terms and conditions. The incoming employer takes on all existing employment liabilities, and both parties have legal obligations to inform and consult affected employees before the transfer takes place. Failing to comply with TUPE can result in tribunal awards of up to 13 weeks’ pay per affected employee.
